These Terms of Service (the “Terms”) govern your access to and use of the services provided by Orizone.io (“Orizone”, “we”, “us”, or “our”).

Our services include our websites, marketing pages, contact and Pulse Preview forms, and Orizone Pulse, our premium B2B decision intelligence software for game studios and publishers, together referred to as the Services.

By accessing or using any part of the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

If there is any discrepancy between the English and French versions of these Terms, the French version will prevail for users located in the European Union or European Economic Area.

01 - Who we are

The Services are operated by Orizone.io, 60 rue Francois 1er, 75008 Paris, France. Additional contact information may be provided on the website. For questions about these Terms, please use the Contact us page and select the Legal / privacy topic.

02 - Eligibility, customer authority, and account registration

You may use the Services only if you are at least 16 years old, or older if required by the laws of your country, and have the legal capacity to enter into a binding agreement with Orizone.

If you use the Services on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms. In that case, “you” and “your” refer to that entity.

To access certain features of Orizone Pulse, you may need to create an account through our authentication provider or another method we specify. You agree to provide accurate, current, and complete information during registration and keep your account information up to date.

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must promptly notify us of any unauthorized use or suspected unauthorized use of your account.

We may refuse, suspend, or cancel an account or workspace if information provided is inaccurate, incomplete, misleading, or if use of the Services violates these Terms.

03 - Description of the Services

Orizone Pulse helps game studios and publishers understand player perception, public discussion, source activity, market context, and customer-provided game context, then turn those inputs into structured, contextualized intelligence for product, production, publishing, marketing, community, and leadership decisions.

The Services may include, for example:

  • websites, landing pages, and public product information;
  • contact, access, and Pulse Preview request workflows;
  • customer workspaces, organization management, user roles, and access controls;
  • source configuration and monitoring for public or customer-authorized sources;
  • signal interpretation, contextual analysis, Pulse intelligence workflows, and customer-visible reports or analysis surfaces;
  • AI-assisted features that support classification, synthesis, interpretation, and decision framing.

Pulse is designed to support decision-making, not to replace professional judgment, customer expertise, product ownership, legal review, community responsibility, or commercial decision-making.

04 - AI-assisted features and decision responsibility

Pulse may use artificial intelligence models and other automated systems to process customer context, source-derived material, prompts, metadata, and product inputs into structured outputs.

You acknowledge and agree that:

  • AI-assisted outputs may be incomplete, inaccurate, delayed, or inappropriate, and may not always reflect all relevant context.
  • You remain responsible for reviewing, validating, and deciding whether and how to use any Pulse output, analysis, suggestion, recommendation, or decision framing.
  • The Services do not provide legal, financial, investment, medical, safety, or other regulated professional advice.
  • Pulse outputs should be used as an intelligence and alignment aid, not as the sole basis for decisions that materially affect players, employees, partners, communities, or commercial outcomes.

05 - Beta features, previews, and pilots

From time to time, Orizone may offer new, preview, pilot, experimental, or beta features, including Pulse Preview workflows and early commercial pilots.

These features are provided for evaluation, testing, feedback, or scoped commercial exploration. They may change at any time, may be less reliable than other parts of the Services, and may be discontinued without notice unless a separate written agreement states otherwise.

Any sample, preview, demo, or pilot output is provided to help evaluate Pulse. It does not guarantee future results, commercial performance, player reception, or availability of a specific feature.

06 - Your use of the Services

Subject to your compliance with these Terms and any applicable customer agreement, Orizone grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for your internal business purposes only.

You agree not to:

  • use the Services in any manner that violates any applicable law or regulation;
  • use the Services to infringe the rights of others, including privacy, publicity, contractual, and intellectual property rights;
  • submit content or configure sources that you are not authorized to share, monitor, or process;
  • upload, store, or share content that is unlawful, harmful, abusive, harassing, defamatory, obscene, hateful, discriminatory, or otherwise objectionable;
  • attempt to gain unauthorized access to systems, networks, accounts, workspaces, source integrations, or data related to the Services;
  • probe, scan, or test the vulnerability of the Services or any related system or network;
  • interfere with or disrupt the Services, including by transmitting viruses, malware, or other harmful code;
  • reverse engineer, decompile, disassemble, or attempt to derive the source code, architecture, prompts, models, pipelines, or non-public logic of any part of the Services, except where permitted by mandatory law;
  • use the Services to develop, train, benchmark, or improve competing products or services in a way that violates these Terms or applicable law;
  • sell, resell, sublicense, lease, or otherwise make the Services available to any third party except as expressly permitted by Orizone;
  • use the Services in high-risk contexts where inaccurate or incomplete outputs could result in death, personal injury, severe physical damage, or severe environmental damage.

We may investigate, suspend, or terminate access if we suspect a breach of these Terms or misuse of the Services.

07 - Customer content and source configuration

“Customer Content” means any content, context, configuration, data, notes, source settings, prompts, files, labels, business information, title information, roadmap or update context, internal context, or other material you submit, import, configure, or otherwise make available through the Services.

You retain all rights, title, and interest in and to your Customer Content, subject to the rights granted to Orizone under these Terms and any applicable customer agreement.

To operate, maintain, secure, and improve the Services, you grant Orizone a worldwide, non-exclusive, royalty-free license to use, reproduce, host, store, process, modify, adapt, translate, display, and create analytical outputs from Customer Content solely for the following purposes:

  • providing and operating the Services, including Pulse intelligence workflows and AI-assisted features;
  • configuring and monitoring customer-authorized sources;
  • maintaining, securing, troubleshooting, and supporting the Services;
  • preventing fraud, abuse, or security incidents;
  • complying with legal obligations;
  • improving and developing the Services, in aggregated or anonymized form where reasonably possible.

You are responsible for ensuring that you have all necessary rights, authorizations, notices, and legal bases to submit Customer Content and configure any source, integration, private community, internal context, or third-party material for processing by Pulse.

08 - Third-party platforms, sources, and integrations

The Services may allow you to configure, process, reference, or interact with third-party platforms, sources, services, or materials, including public reviews, community discussions, video or social reactions, private communities, support context, analytics context, internal notes, or other sources relevant to a customer title.

When you configure or authorize a third-party source:

  • you authorize Orizone to access and process the relevant material on your behalf as necessary to provide the Services;
  • your use of the third-party platform remains governed by that platform’s own terms, policies, permissions, and privacy practices;
  • you remain responsible for ensuring that private or internal sources are configured and authorized lawfully;
  • Orizone does not claim ownership over raw third-party platform content.

Third-party services and platforms are not controlled by Orizone. We are not responsible for their availability, behavior, terms, policies, data access decisions, rate limits, or changes.

09 - Plans, subscriptions, pilots, billing, and payments

Some features of the Services may be offered on a paid subscription, pilot, preview, evaluation, or custom commercial basis. Details of available plans, scope, pricing, limits, and included features may be provided on the website, in the application, in an order form, or in a separate customer agreement.

We may change plans, pricing, limits, or features from time to time. Changes apply to new subscription periods or new orders unless a separate agreement states otherwise. If required by law or contract, we will notify you in advance of significant changes.

If you subscribe to a paid plan or enter a paid pilot:

  • you authorize Orizone and its payment provider to charge applicable fees using the payment method or invoicing process agreed with you;
  • fees are generally non-refundable, except where required by law or expressly stated otherwise;
  • you are responsible for applicable taxes, duties, or charges imposed by public authorities;
  • if payment cannot be processed, we may suspend or limit access until payment is completed.

You may cancel a subscription according to the process described in the application, order form, customer agreement, or instructions provided by Orizone. Cancellation does not automatically delete your account, workspace, or data.

10 - Intellectual property

The Services, including the website, application, product design, software, interfaces, source code, workflows, prompts, analysis framework, models to the extent owned or licensed by Orizone, documentation, logos, trademarks, and related materials, are owned by Orizone or its licensors and are protected by intellectual property laws.

Except for the limited license granted in these Terms, nothing transfers any intellectual property rights to you.

You may provide comments, suggestions, or ideas about the Services (“Feedback”). By providing Feedback, you grant Orizone a worldwide, perpetual, irrevocable, royalty-free license to use, modify, and exploit the Feedback without restriction or obligation to you.

11 - Privacy and data protection

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect personal data. The latest version is available on the website.

If you use the Services on behalf of others, including employees, contractors, team members, community members, players, creators, or partners, you are responsible for ensuring that you have a legal basis to share or configure their data for processing and that they are informed where required by applicable data protection laws.

12 - Confidentiality

During use of the Services, either party may receive non-public information from the other party that should reasonably be understood as confidential, including product information, customer context, business information, source configuration, roadmaps, technical information, pricing, security information, or non-public Pulse outputs.

Each party agrees to protect the other party’s confidential information using reasonable care and to use it only for the purposes of providing, receiving, evaluating, or supporting the Services. Confidentiality obligations do not apply to information that is public through no breach, independently developed, lawfully received from a third party, or required to be disclosed by law.

13 - Disclaimers

To the fullest extent permitted by law:

  • the Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory;
  • Orizone does not guarantee that the Services will be uninterrupted, error-free, secure, or free from harmful components;
  • Orizone does not guarantee the accuracy, completeness, reliability, timeliness, commercial impact, player impact, or strategic outcome of Pulse outputs or AI-assisted features;
  • Orizone does not guarantee that use of the Services will increase sales, retention, player satisfaction, ratings, reviews, community trust, or commercial performance;
  • Orizone does not provide legal, financial, investment, medical, safety, or other regulated professional advice.

Nothing in these Terms excludes or limits any warranty or liability that cannot be excluded or limited under applicable law.

14 - Limitation of liability

To the fullest extent permitted by law, and subject to the final paragraph of this section:

  • Orizone will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, goodwill, business opportunity, commercial performance, player reception, or reputation, arising out of or in connection with the Services.
  • Orizone’s total aggregate liability for any claims arising out of or relating to the Services or these Terms will be limited to the greater of the amounts you have paid to Orizone for the Services during the twelve months preceding the event giving rise to the claim, or one hundred euros.

Nothing in these Terms is intended to exclude or limit liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law, including mandatory consumer rights.

If you are a consumer located in the European Union or European Economic Area, your statutory rights remain unaffected.

15 - Indemnification

To the extent permitted by law, you agree to indemnify, defend, and hold harmless Orizone and its officers, directors, employees, contractors, and agents from and against claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in connection with:

  • your use of the Services;
  • your Customer Content or source configuration;
  • your breach of these Terms or applicable law;
  • your unauthorized use of third-party platforms, private communities, internal data, or third-party content through the Services.

This obligation does not apply if you are a consumer and such an obligation would be contrary to mandatory consumer protection law in your jurisdiction.

16 - Suspension and termination

We may suspend or limit access to the Services, or terminate an account or workspace, if:

  • you materially or repeatedly breach these Terms;
  • you use the Services in a way that may cause harm to Orizone, the Services, other users, customers, third-party platforms, or third parties;
  • payment is overdue;
  • we are required to do so by law, court, authority, or platform restriction;
  • we discontinue the Services in whole or in part.

Where reasonable, we will notify you in advance and provide the reasons. We may act without notice if immediate action is necessary to protect the Services, other users, customers, third parties, third-party platforms, or Orizone.

Upon termination, your license to use the Services ends immediately, and we may delete or anonymize data according to our Privacy Policy, customer agreement, and applicable law.

17 - Changes to the Services and these Terms

We are continually improving the Services and may add, modify, or remove features from time to time.

We may update these Terms from time to time. When we do, we will publish the updated version on the website and indicate the latest revision date.

If a change is material and negatively affects your rights or the way you use the Services, we may notify you in the application, by email, or by other reasonable means. Your continued use of the Services after updated Terms become effective constitutes your acceptance of the changes.

If you do not agree with updated Terms, you must stop using the Services and, if applicable, cancel your subscription.

18 - Governing law and jurisdiction

These Terms and any dispute arising out of or in connection with them or the Services are governed by the laws of France, without regard to conflict of law principles.

If you are acting as a business user, any dispute arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of Paris, France.

If you are a consumer residing in the European Union or European Economic Area, you may benefit from mandatory provisions of the law of your country of residence and may bring legal proceedings in the courts of your country of residence.

19 - Miscellaneous

If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations in connection with a merger, acquisition, sale of assets, reorganization, or by operation of law.

No failure or delay by Orizone in exercising any right under these Terms will be deemed a waiver of that right.
